Experts from around the nation gathered at ASU’s Sandra Day O’Connor College of Law (SDOC) on January 16, 2016 to discuss the high cost of prescription drugs and First Amendment issues concerning off-label marketing. George Poste set the stage and context regarding the pricing of pharmaceuticals noting that we, as a society, cannot consider drug pricing on its own. Drug pricing, said Poste, is part of a multidimensional matrix, that takes patient, payer, manufacturer & regulatory bodies into account and where both economics and emotions are in play. George Poste was followed by Jenny Bryant, representing the pharmaceutical research and manufacturing industry, who put the cost of prescription medicine costs in context. The conference continued with lively, varied and distinguished discussions on whether drug pricing is a problem, potential solutions to the alleged problem and the tension between off-label advertising and free speech. The conference was presented by SDOC and the Center for Law, Science & Innovation‘s Governance of Emerging Technologies Program.
